GENERAL TERMS AND CONDITIONS – MANUFACTURER’S WARRANTY FOR MOTORCYCLE HELMETS, CLOTHING AND GLOVES

Held Ltd (hereinafter: “Held”) grants the end customers of the motorcycle helmets, clothing and gloves mentioned under 1.1, subject to the following conditions, services within a manufacturer’s warranty (hereinafter: “Held 5-Year Guarantee”). These services exist in addition to the statutory warranty claims.

To participate in the Held 5-Year Guarantee, the following terms and conditions apply:

1. Scope of products covered by Held 5-Year Guarantee
1.1 The Held 5-Year Guarantee applies to all Held by SCHUBERTH helmets, Held eVest/Air Vest, Held Gore-Tex® gloves, as well as Held Gore-Tex® clothing
1.2 The Held 5-Year Guarantee is valid worldwide.

2. Scope of the Held 5-Year Guarantee
2.1 The Held 5-Year Guarantee is valid for a period of five years from the date of the new product’s purchase from a dealer by an end customer.
2.2 Risks and damages covered by the Held 5-Year Guarantee
Material and manufacturing defects of the Held product in the participant’s possession are covered on condition that it has been used properly.
2.3 Risks and damages not covered by the Held 5-Year Guarantee
All other risks and damages are not covered by the Held 5-Year Guarantee, in particular:
2.3.1 helmets, gloves and clothing involved in an accident
2.3.2 damages caused by external impact
2.3.3. maintenance mistakes and damage from improper use (intentionally or unintentionally)
2.3.4. simple scratch and scuff damage, which does not affect the function of the product
2.3.5. ordinary wear and tear
2.3.6. damage due to improper maintenance
2.3.7. damage caused by manipulation or modification of the product.
2.4 Services under the Held 5-Year Guarantee are also excluded if the participant intentionally or negligently causes the risks or damages contained in section 2.2.

3. Use of the warranty
3.1 In order to receive the warranty services, the end customer must submit the affected product together with the registration confirmation (see section 3.2) and/or with the proof of purchase to his Held dealer.
3.2 It is not necessary to submit proof of purchase or any other suitable proof if the end customer has successfully registered online to participate in the Held 5-Year Guarantee at the address www.held.de and has uploaded the corresponding proof. As part of the registration, the end customer receives an e-mail confirmation to the e-mail address they provided.
3.3 The end user should, if possible, attach a short written description of the product defect.
3.4 The end customer must also include their name, their full address and a telephone number under which they can be reached during the day.
3.5 If a claim under the Held 5-Year Guarantee exists according to these Terms and Conditions, Held will, at its own discretion, repair or replace the product or refund the purchase price. The settlement takes place via the authorised dealer.

4. Use and disclosure of personal data
The collection, use and disclosure of the end customer’s personal data takes place according to Held Ltd’s Privacy Statement communicated via the homepage at registration. Personal data of non-registered end customers is used without separate consent exclusively for processing the warranty claim.

5. Terminating the Held 5-Year Guarantee
Held Ltd reserves the right to discontinue the Held 5-Year Guarantee at any time. From the time of termination, no warranty claims will be accepted which were purchased after the date of the termination. The participation of already registered customers is just as little affected by this as already concluded purchase agreements with warranty claims.

6. Legal warranty claims
If defects in the Held product occur in the first two (2) years from the date of purchase, the end customer has the statutory warranty claims against the dealer from whom they purchased the product in addition to the warranty. These claims are not limited by the Held 5-Year Guarantee.

7. Final provisions
7.1 Only the law of the Federal Republic of Germany applies to the Held 5-Year Guarantee.
7.2 Place of jurisdiction is Sonthofen (Germany), if
7.2.1 the end customer is a trader;
7.2.2 the end customer does not have a general place of jurisdiction in the Federal Republic of Germany or their place of residence or permanent address is relocated outside of the scope of the Federal Republic of Germany after conclusion of the contract;
7.2.3 if the place of residence or permanent address of the party against whom legal action is being taken is not known at the time the action is filed.
